ORDER ESTABLISHING POLICIES FOR
DENTON COUNTY FRESH WATER SUPPLY DISTRICT 1-B

THE STATE OF TEXAS

COUNTY OF DENTON

DENTON COUNTY FRESH WATER SUPPLY DISTRICT NO. 1-B 

The Board of the Directors of Denton County Fresh Water Supply District No. 1-B met in regular session, open to the public, at an office of the District, inside the boundaries of the District, whereupon the roll was called of the members of the Board, to-wit:

Lance Shirey                           President

Guy Harris                              Vice President

Jason Bahamundi                    Secretary/Treasurer

Patrick Kelly                           Assistant Secretary

James Beveridge                     Assistant Treasurer

All members of the Board were present except Jason Bahamundi                                 .

WHEREUPON, among other business conducted by the Board, Director James Beveridge moved adoption of the Order, which motion was seconded by Director Patrick Kelly, and after a full discussion and the question being put to the Board of Directors, said motion was carried by the following vote:

“Aye”      4  ;                             “No”   0  .

The Order thus adopted is as follows:

WHEREAS, Denton County Fresh Water Supply District No. l-B (the “District”) is a water control and improvement district operating pursuant to Chapter 49, Chapter 51 and certain retained provisions of Chapter 53, of the Texas Water Code, as amended; and

WHEREAS, the Texas Water Code requires the District to adopt certain policies; and

WHEREAS, the Board desires to reduce to writing all policies adopted by the District; and

IT IS THEREFORE, ORDERED BY THE BOARD OF DIRECTORS OF DENTON COUNTY FRESH WATER SUPPLY DISTRICT NO. 1-B THAT:

I.

The following District policies are hereby ratified and adopted:

 

Exhibit A Ethics Policy (amended July 17, 2012)
Exhibit B Travel Expense Policy (amended July 17, 2012)
Exhibit C Investment Policy (amended May 1, 2012)
Exhibit D Policy Concerning Selection Monitoring, Review, and Evaluation of Professional Consultants (adopted March 20, 2012)
Exhibit E Policy Concerning Accounting for Industrial Development Bonds and Pollution Control Bonds
Exhibit F Policies Relating to Use of Management Information and Formation of an Audit Committee (adopted February 12, 2002)
Exhibit G Policy Regarding Disbursement of Funds and Check Signing Policy (amended July 17, 2012)
Exhibit H Policy Establishing Records Management Program and Appointing Records Management Officer (adopted March 22, 2011)
Exhibit I Open Records Request Policy (adopted January 17, 2012)
Exhibit J Agenda Postings for Board Meetings (adopted July 17, 2012)
Exhibit K Posting Documents to Website (adopted July 17, 2012)

II.

The following policies are currently under review by the Board for consideration and adoption in the future:
Financial Policies and Procedures Regarding Possession and Control of Cash Funds
Accounting Policies
Enterprise Fund Policy (if appropriate)
Utility Fund Policy (revenue neutral)
Capital Reserves Policy
Operating Reserves Policy
Request for Proposal Policy for Professional Services
Retaining Wall Policy (purpose, ownership and maintenance)
Park Policy (maintenance and ownership)
Policy for Property Appraisals with Denton Central Appraisal District (November 16, 2005)

The Board concluded the following policies are not needed by Denton County Fresh Water Supply District No. 1-B at this time:
Attendance at Regular Meetings of the Board
Public Comments at Meetings of the Board of Directors
Succession of Board Leadership
Presentations to Board – Cut-Off Dates
Correspondence Guidelines
Vehicle and Equipment Replacement Policy
Use of the District’s Boardroom for Meetings of Other Organizations

III.

 

This Order shall supersede any previous orders establishing policies for the District.  The President or Vice President of the District is authorized to execute this Order on behalf of the Board of Directors and the Secretary or Assistant Secretary is authorized to attest to the same on behalf of the District.

PASSED, ADOPTED, ORDERED and EFFECTIVE this 28th day of August, 2012.
